1.
Karen and Roger Murphy ("the Owners") offer the property known Casa Mariposa B3-4 La Finca and Casa Romero (Penthouse) B5-5 Las
Terrazas for holiday rental subject to confirmation to the Rentee ("the Client")
2. RESERVATION PROCEDURE
a
To reserve the "Property" the Client should complete and return the booking
form on-line.
b. Non refundable deposit (25% of total rent) to be RECEIVED by Owners within 3
days of receipt of booking form (if paid by Bank Transfer) immediate receipt (if
paid by Paypal)
d.
Confirmation of Booking will be sent by Owners to Clients immediately upon
receipt of deposit monies by email. This is the formal acceptance
of the booking

The balance of the rent together with security deposit (clause 5) and any extras
are payable not less than eight weeks before the start of the rental period. by Bank
Transfer . If payment is not received by the due date, the Owners reserve the right
to give notice in writing that the reservation is cancelled. The Client will remain l
liable to pay the balance of the rent unless the Owners are able to re-let the
property. In the event, clause 6 of the booking conditions will apply. Reservations
made within 8 weeks of the start of the rental period require full payment at the
time of booking.
4. CANCELLATION PROCEDURE
Cancellations within the 8 week period before the departure date will incur charges
as follows: 8-4 weeks - 50% of total cost of rent. Less than 4 weeks - 100% cost of
rental.

Any chargeable expenses arising during the rental period should be settled locally
by the Client BEFORE departure. from Spain.

A security deposit of £200 is required in case of, for example, damage to the
property or its contents howsoever caused during the rental period, international
telephone calls for the properties with a telephone. and any chargableexpenses not
paid for direct by the Clients before departure. However, the sum reserved by
this clause shall not limit the Client's liability to the Owners. The Owner will
account to the Client for the security deposit and any additional expenses and refund the balance due withi n two weeks of the departure date following receipt
of an emailed Report from local Manager in Spain

Subject to clause 4 above, in the event of a cancellation, refunds of amounts
will be made if the Owners are able to re-let the property and any expenses or
losses incurred in so doing will be deducted from the refundable amount. The Client
will ensure that every member of his/her party has a comprehensive travel insurance
policy to include cancellation cover, medical and accident cover, personal
belongings cover (including loss or theft), public liability etc as this is not covered
on the Owners insurance. All baggage and personal possessions remain at all times
and in all circumstances at the Clients risk.

The Rental Period shall commence at 2.00pm on the first day and finish at 10.00am
on the last day. The Owner shall not be obliged to offer the accommodation before
the time stated and the Client shall not be entitled to remain in occupation after the
time stated unless previously agreed with Owners. Any Clients remaining after
10.00 am will incur an additional day's rental which shall be deducted from the
security deposit held.

Only the Clients named on the booking form are allowed to occupy the property. The
maximum number permitted to reside in the property shall be 6 (plus a baby)
10. The Client agrees to be a considerate tenant and take good care of the "property"
and leave it in a clean and tidy condition at the end of the rental period. The Owner
reserves the right to make a retention from the security deposit to cover any
'additional' cleaning costs.
11. The Client agrees not to act in any way, which would case disturbance to those
residents in neighbouring properties. The Owner reserves the right to terminate
without compensation the rental period of any Client abusing the property or its
contents or whose behaviour is considered unreasonable.
12. The Client shall report to the Owner without delay defects in the property or
breakdown in the equipment, plant, machinery or appliances in the "property".
Under no circumstances shall the Client arrange for any works to be carried out
whatsoever to the property or its contents without prior approval of the Owner.
13. The Client shall be liable for any loss damage or inconvenience caused to or
suffered by the Owner during or after the rental period resulting from any damage
to the property or its contents which includes (but is not limited to) any damage
or inconvenience arising from loss of keys
14. The Owner shall not be liable to the Client:
a. For any temporary defect or stoppage in the supply of public services to the
"property" nor in respect of any equipment, plant, machinery or appliance in the
"property", garden or swimming pool. or any change to the facilities offered either
within the property or on the Golf Resort
b. For any loss arising from adverse weather conditions, riot, War, strikes or other
matters beyond the control of the Owner.
c. For any death personal injury accident loss or damage to persons or personal
effects howsoever caused
d. For any loss, damage or inconvenience caused to or suffered by the Client if the
"property" shall be destroyed or substantially damaged before the start of the
Rental Period, in such event the Owner shall within seven days of notification to
the Client, refund the Client the rental fee paid .
15 UNDER NO CIRCUMSTANCES SHALL THE OWNERS LIABILITY TO THE CLIENT
EXCEED THE AMOUNT PAID TO THE OWNERS FOR THE RENTAL OF THE
PROPERTY
16. This contract shall be governed by English law including formation and
interpretation and shall be deemed to have been made in England. Any proceedings
arising out of or in connection with this contract may be brought in any court or
competent jurisdiction in England.
The all inclusive price includes a full "check-in" clean prior to arrival, fresh
laundry and towels, all beds prepared full "check-out" clean on departure.
(No additional costs on arrival)
Cot and high chair available for hire (£20-00 each)
Daily maid service and extra laundry service available if required. A pack
of basic foodstuffs can be arranged ready for your arrival (£25-00)
We can also arrange discounted golf if pre booked in advance on most of
the major Golf Courses available in this world renowned "Costa del Golf" region.
